Summary: The Union alleges that ABLE management and their consultant John Hawkins violated the National Labor Relations Act by threatening to retaliate against employees if they joined or supported a union; promising better working conditions if employees did not join or support a union; engaging in surveillance or creating impression of surveillance of employees’ union activities; interrogating employees about their union activity; maintaining work rules that prevent or discourage employees from forming, joining, or supporting a labor organization and protected concerted activities. Further, the Union alleges ABLE management violated the rights of the Long-term Care Ombudsman Program (LTCOP) staff by trying to force them into the bargaining unit against the wishes of the majority of that cohort, in order to try to dilute the potential vote of the rest of the union eligible staff. LTCOP workers do not share a community of interest with other ABLE workers because ABLE is merely the sponsoring agency of LTCOP while the program is statutorily managed by the State of Ohio Long-term Care Ombudsman.<\/p>\n
