Toledo Municipal Court Hearing on Ohio Building Protesters

Ohio Building protesters, including the President of Veterans for Peace, Mike Ferner, and organizers of the NW Ohio Peace Coalition, were arrested on October 3, 2025, for using crime scene tape to block the entrance of Senator Jon Husted’s downtown Toledo office. Although approximately 30 people were present for the protest, the defendants: Steve Masternak, Susan Kuehn, Al Compaan, Nancy Larson, and Mike Ferner refused to move after warnings from law enforcement. This refusal led to their arrest for “disorderly conduct/hindrance/prevent movement” (11 ORC 2917.11A4). The protesters are calling on Senator Jon Husted to do more to stop the war in Gaza.
The goal of the protest is to increase awareness about the inhumane and unjust war in Gaza. The protesters are asking Husted to stand up for Phil Tottenham, a Toledo resident & veteran who was held in an Israeli prison for helping to send humanitarian aid to Gaza and to help with the humanitarian crisis in Gaza. The protesters’ message is to wake the American people up and to motivate us to not be complicit, by being silent, about wars and the harm they cause. More importantly, their message goes out to each and everyone of our elected officials, who are complicit and breaking the law daily by sending taxpayer money to Israel to use against the civilian population. Hamas attacked Israel on Oct. 7, 2023, killing thousands of people and taking hundreds more as hostages.
The Toledo Municipal Court hearing for the protesters arrested was held on March 4, 2026. La Prensa, Inc. was not allowed into the courtroom during the jury selection; however, we did receive comments from Mike Ferner, who stated that “During jury selection, one of the questions the attorney for the protesters, Terry Lodge, asked of the pool of 35 people selected for jury was: How many of them had ever participated in a political protest? About a dozen people raised their hands, most of whom had been to a ‘No Kings’ rally/protest.” The trial lasted from 8:30 am to 6:30 pm, with two hours of jury deliberations. The City’s case consisted largely of bodycam footage from the day of the Ohio Building protest that showed the protesters clearly explaining to the police why they were protesting and their intent to stay.
According to Mike Ferner, “all the defendants responded to questions on the stand as best they could, expecting to be overruled if they mentioned anything about why they protested.” They talked about having Palestinian friends in Toledo who had many family members killed, how the war criminals are in Congress, and the administration should be the ones arrested for starving people and attacking health care systems. “This all added up,” according to Mike Ferner, “to the jury being given a good understanding of why we protested and the depth of our concern and commitment. They filled the rest of the blanks in with their own compassion and humanity, overruling the court’s instructions to consider only the charge of disorderly conduct and nothing about our motivations.” After a long day in court, the jury could not reach a “unanimous” verdict to convict or acquit.

Hamás atacó a Israel el 7 de octubre de 2023, matando a miles de personas y tomando a cientos más como rehenes.
El Tribunal Municipal de Toledo para los manifestantes arrestados fue el 4 de marzo de 2026. La Prensa, Inc. no pudo entrar en la sala durante la selección del jurado; sin embargo, sí recibimos comentarios de Mike Ferner, quien afirmó que “Durante la selección del jurado, una de las preguntas que el abogado de los manifestantes, Terry Lodge, hizo al grupo de 35 personas seleccionadas para el jurado fue: ¿Cuántos de ellos habían participado alguna vez en una protesta política? Unas doce personas levantaron la mano, la mayoría de las cuales habían asistido a una manifestación/protesta ‘No Kings’.” El juicio duró de 8:30 a 18:30, con dos horas de deliberaciones del jurado. El caso de la ciudad consistió principalmente en imágenes de cámaras de la policía el día de la protesta en el Edificio Ohio que mostraban a los manifestantes explicando claramente a la policía por qué protestaban y su intención de quedarse.
Según Mike Ferner, “todos los acusados respondieron a las preguntas lo mejor que pudieron, esperando ser revocados si mencionaban algo sobre por qué protestaron.” Hablaron de tener amigos palestinos en Toledo que tuvieron muchos familiares asesinados, de cómo los criminales de guerra están en el Congreso y deberían ser arrestados por matar de hambre a la gente y atacar sistemas sanitarios. “Todo esto sumaba,” según Mike Ferner, “a que el jurado entendiera bien por qué protestamos y la profundidad de nuestra preocupación y compromiso. Rellenaron el resto de los vacíos con su propia compasión y humanidad, anulando las instrucciones del tribunal de considerar solo el cargo de alteración del orden público y nada sobre nuestras motivaciones.” Tras un largo día en el tribunal, el jurado no pudo llegar a un veredicto “unánime” para condenar o absolver.
